Disclaimer: Terms of Service & Liability

1. General Disclaimer Pacific Freight Link ("the Company") provides freight forwarding, logistics, and customs services subject to these terms. While we exercise all reasonable care, all services are provided at the customer's risk. The Company is not a common carrier and reserves the right to refuse the carriage or transport of goods at its discretion.

2. Limitation of Liability To the maximum extent permitted by the Australian Consumer Law, the Company’s liability for any loss, damage, or delay to goods is limited to:

  • The cost of providing the services again; or

  • A specific dollar amount per shipment (as defined in our Standard Trading Conditions). We strongly recommend that customers arrange their own comprehensive marine or transit insurance, as our liability is limited and does not automatically cover the full value of the cargo.

3. Payment Terms and Right of Lien All invoices must be paid in full by the due date specified. If full payment for services provided is not received:

  • Possessory Lien: The Company exercises a general and particular lien over any and all shipments (and associated documents) currently in our possession. We reserve the right to hold shipments and refuse delivery until all outstanding balances, including interest and costs, are paid in full.

  • Additional Charges: Late payment fees ($[Insert Amount or %]) and daily storage fees will apply to any goods held due to non-payment. These fees will accrue from the date payment was due until the date of release.

4. Abandoned Goods and Power of Sale If an account remains unpaid for a period exceeding [e.g., 30 or 60] days, or if goods remain uncollected for that same period, the Company may:

  • Deem the goods abandoned.

  • After providing written notice to the customer's last known address, sell or auction the items by public or private sale to recover all outstanding costs, including the original debt, storage fees, and the costs of the sale.

  • Any surplus funds following the sale will be returned to the customer (less administrative costs); however, if the sale does not cover the debt, the customer remains liable for the balance.

5. Indemnity The customer agrees to indemnify the Company against all hardware damage, fines, or penalties incurred due to inaccurate documentation or the provision of hazardous/restricted goods without prior written disclosure.
